第一章 总则

第二章 接受工作

第六条 凡以政府名义接受的留学生，由国家教育委员会审批；各院校在完成国家任务的前提下，通过校际交流或其他途径接受的留学生，由接受院校审定，报上级主管部门和国家教育委员会备案。

第三章 教学工作

第十一条 中专生、专科生、本科生和研究生修业期满，成绩合格的，发给毕业证书；成绩不合格的，发给结业证书。凡中途退学的，按有关规定发给肄业证书，证书上注明学习年限。进修生完成进修计划，发给进修证书。

第十二条 关于留学生使用教材、图书、档案、资料：
（一）凡提供给本专业中国学生的教科书、讲义、参考资料等，原则上应向留学生提供。留学生可向图书馆按规定借阅图书、报刊、文献、资料。允许留学生订阅国内公开发行的书刊、报纸、所在学校的学报和《参考消息》。如专业学习需要，又不涉及国家机密，经学校领导批准，可向留学生提供国内不公开发行的书刊、资料。

第四章 专业实习和社会实践

第五章 思想政治工作和政治活动管理
第十六条 对留学生要进行入学教育，介绍我国的有关法律和规章制度，帮助他们了解我国的教育制度，适应我国的生活习惯。结合留学生的思想情况，要经常进行勤奋学习、遵守法纪、团结友好的教育，帮助他们了解我国的政治、历史、文化、经济和风俗习惯，并根据不同对象，介绍我国的政治主张。思想政治工作要有针对性，通过耐心细致、灵活多样、生动活泼的方式进行。提倡中国师生同留学生交朋友。
第十七条 留学生可以参加我国公开的政治活动和所在学校中国学生会的有关活动。我国为国内、国际重大节日、纪念日和重大事件举行的集会、游行等活动，留学生可自愿参加，学校应加强领导，做好组织管理。
不吸收留学生参加我国内部的政治性活动。

第十九条 对留学生的重要传统节日或宗教节日（如宰牲节、圣诞节、复活节等），学校不放假，如学生请假，可准假一至三天；由外地回驻华使馆过节者，准假不超过七天。校内不提供进行宗教仪式的场所。如留学生要求到寺庙或教堂举行宗教仪式，可自行联系前往。
第二十条 留学生在校内成立以学习和友好为目的的本国或多国的学生组织，应由组织者向学校提出书面申请，经学校批准后报当地公安机关备案；成立跨学校跨地区的组织，举行集会或游行，均应由组织者向当地公安机关申请，按我国有关规定办理。
第二十一条 外国驻华使领馆人员到学校同本国留学生会面，应按照会客制度进行。如要求学校提供场所，可同意。如要求学校安排会见其他国家的留学生或举办有其他国家留学生参加的活动，应视不同对象和条件，或婉拒或允许其自行联系。
留学生或外国使领馆邀请我师生前往使领馆观看电影或参加其他活动，应按有关规定办理。
第二十二条 在政治理论教学和思想工作中，要划清政治问题、学术问题和生活方式之间的界限。在政治问题上，要划清模糊认识、不同的政治观点同污蔑和挑衅性言论之间的界限。对有模糊认识的，应耐心进行解释；对有不同政治观点的，应正面说明我们的观点，求同存异；对污蔑和挑衅性的言论，应严正表明我们的立场，但不与纠缠。在学术问题上，允许学生自由讨论和发表自己的见解，不要强求一致。对生活方式问题，只要不触犯校规和我国法律，不要干预。
第六章 学籍管理
第二十三条 要认真按照学校的学生学籍管理规定，对留学生进行管理。对遵守纪律、学习优秀的留学生，学校可予以表扬，发给奖状和奖品，也可召开表彰大会，在全校公布。留学生在校外做了好事，学校要及时予以口头或书面表扬，并视情况发给适当奖品。
学校应将受表彰留学生的情况书面通知其驻华使领馆或派遣单位。
第二十四条 对犯错误留学生的校纪处分为警告、严重警告、记过、留校察看、勒令退学和开除学籍。
给予留学生勒令退学和开除学籍处分的，须经学校的上级主管部门审核，报国家教育委员会批准。其他校纪处分由学校决定。
留学生在有可能受到勒令退学和开除学籍的处分时，学校要提前书面向当事人重申规定，说明后果，并抄送有关驻华使领馆或派遣单位，以争取他们的合作。
对受留校察看处分的留学生，一年内有进步表现的，可解除处分。对经教育不改的，可勒令退学；勒令退学的审批权限，按本条第二款办理。
校纪处分一经决定，除向当事者宣布外，学校应书面通知有关驻华使领馆或派遣单位。
第二十五条 对留学生的成绩考核、升级与留（降）级、休学与退学的管理，原则上应当与中国学生相同。预科学习的不留级。凡实行学分制的院校按各校规定办理。若有关驻华使领馆索取留学生的成绩单和学习评语，可由学校直接提供。
第二十六条 留学生因病短期不能恢复健康或因考勤考绩需作休学或退学处理时，由学校领导批准，书面通知有关驻华使领馆或派遣单位，并报上级主管部门和国家教育委员会备案。
留学生要求休学、退学，需由驻华使领馆或派遣单位向学校出具证明，经学校批准，报上级主管部门和国家教育委员会备案。以政府名义接受的留学生要求复学、转学、改变专业、改换学生类别和延长学习期限的，由驻华使领馆或派遣单位向国家教育委员会提出，由国家教育委员会审定；通过校际交流或其他途径接受的留学生，由学校审定，报上级主管部门和国家教育委员会备案。
第七章 生活管理和社会管理
第二十七条 必须认真做好留学生的生活管理和社会管理，保证他们的正常学习和生活条件，保护他们的正当权益和安全。应严格执行管理制度，教育他们自觉遵守。对他们的合理要求，要尽可能满足；对不合理的或无条件满足的要求，要及时解释。第二十八条 对留学生的物质生活要适当照顾，但不同于对外宾和专家的招待。要关心他们的健康，努力办好伙食，注意饮食和环境卫生。要尊重他们的宗教信仰和民族习惯，照顾其饮食特点。留学生食堂应建立必要的规章制度，注意改善管理。为留学生工作需要购置的汽车和用房，应保证留学生居住和工作使用。
第二十九条 学校应积极为留学生组织健康的文化娱乐和体育活动，各地文化、体育部门对此应提供方便。学校要做好留学生的日常医疗保健，卫生部门应指定医院负责他们的医疗和住院护理工作。
第三十条 学校在假期中，可组织留学生旅行、参观，了解我国文化和经济建设成就。各省、自治区、直辖市教育主管部门要统一协调安排。其费用标准和负担办法按有关规定办理。学习期间不得请假旅行；利用周末外出旅行者，不得影响正常学习。
留学生临时回国、到第三国或港澳地区旅行，应当由有关驻华使领馆提前十天函告学校，经学校同意后方可办理有关手续。
第三十一条 加强对留学生户口和宿舍的管理，建立必要的规章制度。对本校留学生的户口及变更情况，应当按照规定及时向当地公安机关申报。留学生毕业、结业、休学、退学等，学校要及时为其办理离校手续和户口注销手续。留学生应当遵守学校的会客留宿制度，依照规定办理会客留宿的登记和申报手续。在校内临时留宿外国人（不接待持外交、公务护照者）应当在24小时内向当地公安机关申报。
第三十二条 应当对留学生和经常接触留学生的我国公民，进行正确对待不同国家间男女社交、恋爱和婚姻问题的教育。对留学生与我国公民的正当交往、正当恋爱，不要干预。除中专生、专科生和本科生在校学习期间一般不得结婚外，其他学生要求与中国人结婚而又符合我国婚姻法及有关规定的，可允许他们向我国婚姻登记机关申请登记。学校不提供夫妇用房。

第三十三条 要对广大群众和服务人员进行国际主义和爱国主义教育，防止或克服大国主义和种族主义情绪。对留学生要热情友好，以礼相待，不卑不亢。涉及留学生工作的部门和单位要建立必要的规章制度，做好社会管理。当留学生违反纪律、规章制度或有轻微违法行为时，由当事单位批评教育或依照规定予以处理；如当事单位制止无效，有可能扩大事态时，应当报请公安机关出面协助处理。
第三十四条 留学生的行为对我国家安全、社会秩序或他人利益构成危害时，公安机关可采取强制措施约束他们的行动。对留学生违法需作拘留、限令出境、驱逐出境的行政处罚时，由省、自治区、直辖市公安机关（或报请公安部）通知有关驻华使领馆或派遣单位，并及时通报外交部和国家教育委员会。
对留学生的违法犯罪行为，应当按照我国的法律，由公安、司法机关负责处理。
第八章 组织领导
第三十五条 留学生工作，由国家教育委员会归口管理。其任务是：（一）根据国家的有关方针政策，拟定留学生工作的具体政策和重要的规章制度；
（二）根据有关国家的要求，商谈和签订交换留学生协议；
（三）拟订接受留学生计划和规划；
（四）负责留学生工作的对外谈判和留学生的接受及院校分配；
（五）检查、总结留学生工作，交流工作经验；
（六）处理各有关单位关于留学生教学、管理工作等重要问题；
（七）按照国家接受计划，负责留学生专项经费的拨付与管理，并向财政部统一编报年度决算。
第三十六条 外交部协同国家教育委员会解决留学生工作中涉及方针政策的问题和需要通过外交途径交涉的问题。
第三十七条 文化部根据接受来华留学生计划，同有关国家签订文化协议，并指导开展留学生的文化娱乐活动。
第三十八条 各有关驻外使领馆在国家教育委员会的指导下，负责就留学生事宜对外谈判；对来华留学生组织考核，审查学生申请材料，推荐录取名单，向派遣方和来华学生介绍我国的有关情况和规定；办理留学生的来华签证；调查了解派遣留学生国家的教育情况及回国留学生的有关情况，及时向国内反映。
驻外使领馆有关接受留学生的建议和接受工作中的具体问题，向国家教育委员会请示。
第三十九条 公安部负责指导地方公安机关对留学生入境、出境、居留、旅行的管理和留学生的安全保卫工作及违法事件的处理。
第四十条 国务院有关部门，指导所属院校的留学生教学工作和实习安排，提供接受留学生所需要设施和有关经费。
第四十一条 各有关省、自治区、直辖市人民政府，应加强对留学生工作的领导。
由省、自治区、直辖市外事办公室牵头、协调，负责外事政策的执行和宣传教育。
由教育部门归口，负责日常管理、教学、实习和旅行参观等项工作的协调和组织工作。
地方公安、商业、卫生、体育、铁路、交通、邮电、海关等有关涉及留学生工作的部门和单位，要密切协作，共同做好留学生的社会管理和服务工作。
第四十二条 各有关院校应切实加强对留学生和教育和管理工作，并列入议事日程。正、副校（院）长中应有一人分工负责留学生的工作。学校可设留学生办事机构，负责有关留学生的接受、思想政治工作、日常管理以及与有关使领馆的联系。教务、系、后勤和保卫部门，要分别抓好留学生的教学、生活管理及安全保卫工作。学生会要协助学校开展留学生的业余文化活动，促进友好交往。
第四十三条 要挑选政治条件和业务条件好并热心留学生工作的教师和干部担任留学生的教学和管理教育工作，建立一支稳定的教师和干部队伍。留学生管理干部是外事干部，应当根据工作需要享受有关待遇，提高他们的政策水平和工作能力。
