《中华人民共和国外国人入境出境管理条例》已于2013年9月1日正式实施。《条例》第22条规定，持学习类居留证件的外国人需要在校外勤工助学或者实习的，应当经所在学校同意后，向公安机关出入境管理机构申请居留证件加注勤工助学或者实习地点、期限等信息。持学习类居留证件的外国人所持居留证件未加注前款规定信息的，不得在校外勤工助学或实习。勤工助学就是大家所说的兼职“打工”。
《The Chinese article regulation for foreign nationals》 formally legalized back on first September 2013. Article number 22 mentioning that a student who in status as study visa and working or internship, they must get approval from their school, propose to immigration office for updating a residence permit student and work by adding description about working place or internship, how long time for working or internship, and more related information about working or internship. If the student can’t complete the requirements, student with student visa can’t work or internship. Working here it’s mean working part-time.

在该《条例》颁布之前，有关文件规定在华留学生不能在校外勤工助学，可以在校内从事适当的工作。因此，学校的规定都是不允许留学生外出“打工”，而该《条例》的实行，对外国留学生的实习、勤工助学等进行了规范，是对外国留学生兼职“打工”赋予了合法性，它告诉大家：留学生在校外兼职“打工”或实习合法。但是，需要得到学校的同意和公安局在居住证上标注。法律给予了留学生申请兼职“打工”和校外实习的权利。
Before the article is legalized, previously foreign student are not allowed to work. Therefore the school does not allow foreign student to work, but after the article is approved, there are new regulation that allow foreign student to work with the requirement were approved by the school and had reported to Immigration Office about residency, propose the petition to do part-time work or internship outside of the school.

留学生怎样实现合法兼职“打工”呢？首先，在选择留学学校时，咨询该校能否同意兼职“打工”？在报名时选择适合自己的学校。第二，在校学生可以主动与学校领导沟通，争取所在学校的支持，制定出关于本校留学生兼职“打工”的管理办法，学校不是一概不同意，用办法来约束留学生的行为。同时，学生们要遵守管理办法，这样产生良性互动。第三，选择合适的兼职“打工”岗位，考虑到：安全、方便、与学习内容有关的因素，使学校放心。如：不出校门的网络工作、学校周边小区的服务类工作、学校附近的企业工作等。
